It’s The Constitution .. Stupid.

The US Constitution being ignored is not a compelling reason for a Con-Con.

Donald Trump did (with a pen) what we asked for our GOP legislature to do for the last 6+ years of controlling the house.

Whether he realized it or not, he might well have set the tone for examining presidential actions, and more importantly how the bureaucracy interfaces with the public going forward.  Citing the constitution, the Trump administration has declared it will no longer pay for health care subsidies, period.  From ABC news:

”  the White House said the government cannot legally continue to pay the so-called cost-sharing subsidies because they lack a formal authorization by Congress.

However, the administration had been making the payments from month to month, even as Trump threatened to cut them off to force Democrats to negotiate over health care. The subsidies help lower co-pays and deductibles for people with modest incomes.

Halting the payments would trigger a spike in premiums for next year, unless Trump reverses course or Congress authorizes the money. The next payments are due around Oct. 20. “

Unless he “reverses course?”

He cannot reverse course.  It would be as illegal as Obama making the payments in the first place.  In fact, this very act was already preceded by a declaration that the very payment of those subsidies was unconstitutional, not just yesterday, but actually in APRIL of this year by US attorney general Jeff Sessions:

” Sessions said during a Fox News interview that the payments to insurers, which reimburse them for lowering the cost of copays and deductibles for low-income Obamacare customers and are the subject of a House lawsuit, should be appropriated by Congress.

Sessions’ comments come as insurers are concerned whether the Trump administration will continue to reimburse them for the cost-sharing reductions.

Insurers are required under federal law to provide the reductions for Obamacare and have been getting reimbursed by the federal government. They are expected to receive $7 billion this year.

But Sessions said a lawsuit filed by the House against the Obama administration in 2014 “has validity to it.”

The lawsuit argues that the Obama administration illegally bypassed Congress and didn’t get an appropriation for the payments.

Nobody could say they didn’t see this coming.

But where is the Michigan angle you ask?

Is it truly too late for American individualism?

What just happened should scare the hell out of us.

Healthcare has officially become an entitlement.   You have whole communities full of government junkies and melted away personal responsibility. Elected bureaucracy remains the pusher of socialized (welfare) medicine, and you cannot put enough locks on the safe to keep it out.

Preexisting conditions will remain a mandate on insurers. Even with added penalties for lapses in coverage going forward, accepting, and maintaining responsibility for oneself and one’s family has apparently been cemented as a function of government.

The most humble beginnings

It started simple enough decades ago, with the accepted forms of ‘insurance;’ Social security, Medicare, and for the emergency needs of poverty stricken folks, medicaid.  Soon, it was forcing insurance providers to include pregnancy protection for men, and autism support for parents who won’t stay at home with their own children.

Michigan in total, has added 655,635 to it’s medical welfare rolls as of last Monday.  This taxpayer funded boondoggle known as “Healthy Michigan” was enacted under a ‘Republican’ controlled legislature, and signed into law by a ‘Republican’ governor. And it is sufficiently generous.  The thought of taxpayers providing insurance welfare for those who are 33% above poverty thresholds is maddening.

Hell-thee Michigan

Michigan governor refuses to see the error of his ways.

Republican Rick Snyder has been flat out wrong.

He was wrong when he signed Medicaid expansion into law, and he was still wrong more recently, by defending this costly and inefficient boondoggle.  Sometimes it takes a great governor and statesman from another state to make the point:

“..  Second, Obamacare made millions of able-bodied Americans newly dependent on direct government assistance for their health care. Whether through a massive expansion of Medicaid beyond its original target populations of poor children, disabled and the elderly, or through exchange subsidies for the vast majority of participants, Obamacare masked the true cost of health care, rather than truly “bending the cost curve down.” Pretending that subsidized health care is affordable without considering the true cost to taxpayers is disingenuous at best.  ..”

Thank you Mr Jindal.

Sometimes it just takes the 'B' Team to get the conversation going.

SnydercaidA shame however that they still don’t quite understand why we are ‘right.’

We have pointed out consistently why the ACA was a bad deal.  We have pointed out correctly why Michigan should never have engaged on the self destruct that is ‘Healthy Michigan’ And just the other day we pointed out with reliable and credible sources that our predictions have been spot on.

But knowing there is a problem and correctly identifying it are two different things. We have on multiple occasions offered an accurate ‘why’ of what is going to happen.

Its what we do.

The Ivory Tower now sees there is a problem, yet opines that we are too afraid to pay the taxes for the problem, and that the FEAR of paying IS THE PROBLEM!

“If the Legislature doesn’t extend, and increase, a tax on insurers and some claims administrators, the state won’t be able to fund its current Medicaid programs. In 2017, the state’s costs will go up, something lawmakers have known for years and have they had sufficient time to craft a plan to cover the cost increase.”

A tax increase, or replacement is ALWAYS the solution, yes?

Its like food.  Fill the belly, and eventually there is a biological event that is unavoidable.  The beast that is government is still eating every last liberty and washing it down with the fruit of our labors. The editorial board of the Detroit Free Press bemoans “those who live by this ideology, all taxes are bad, all government is bad, and the only reason to get elected is to cut government past the point of functionality.”

Why should we be surprised that it is, and will continue to be defecating all over the taxpayers

Stop Issuing Marriage Licenses Altogether.

The Supreme Court has spoken!

States should no longer issue licenses for marriage whatsoever.

Already the federal government has determined whether we are capable of governing our own health choices.  The ACA made sure that we are to buy THEIR preferred type of insurance or pay dearly for the failure to do so. The executive office driven EPA has determined that the coal fired plants in Michigan are not worthy of our electric payments, and that we would be better off blacked out and without lights (wait until 2017 folks!)

After today’s ruling it is quite clear that the state of Michigan needs a hands (or paws) off policy with regard to marriage.  The federal government has assumed the responsibility for who is eligible for the license necessary to achieve marital bliss as of this morning. Logically it makes no sense to further burden the stae of Michigan’s legislative code with marriage requirements that have no meaning or cultural protections.  Reasonable people can agree that such language only occupies our books and takes up space.

Our appropriate place in this great experiment of AmeriKa has ended.

The occupiers of the white-house have made it clear that a living constitution CAN be achieved if the push is strong enough. And if the stacking of the court has been properly done, there are numerous goals that can be met, never before imagined.

Go ahead Michigan.

Cut out the middleman.

Well THAT Was Disappointing ..

What at first appeared to be a reach out to get input for a post-SCOTUS ruling direction was just a scam.

Not at all surprising however.

Given that it was from team Benishek. I though perhaps he was noticing how folks have lost all respect for him, and as contrition, was reaching out to see what would make folks a little more confident in his future performance.  Gosh, maybe it was in response to my put up or shut up articles!

The email arrived with this heartfelt message:

Let Them Buy Their OWN Damned Insurance.

We finally have a chance to tell Obama where to shove the atrocity known as the ACA, but ...

State Senator Jim Marleau is simply a two faced Obama sycophant.  He operates under the Republican banner, but he has presented himself as a wimpy cradle-to-grave patriarchal potlicker.  On the upcoming decision in the Supreme Court he doesn’t represent the stated GOP view that Obamacare is bad, but rather wonders aloud (sympathetically) what all the leeches in Michigan will do if their precious health care entitlements go away.  And then he suggests something must be done!

“He could have done it that way to begin with, but he wasn’t really excited about that,” said state Sen. Jim Marleau, R-Lake Orion.

“I think he’d have to. Our back is up against the wall, and we’ve got a lot of people in this state who are using it. That’s the thing. What do you do with those people?”

Let them find their own insurance without fear of penalties you imbecile!

Reconciliation To End Obamacare

Dear Congressmen, you have not done everything in your power yet. The End.

Lying liars.

Frankly that is the first description I have for the Republican Congress critters who have assumed their positions of power in the last few years.  Especially given that there have been several ways to stop Obamacare in its tracks; up to, and including impeachment for executive authority run amuck.

Heritage makes a point that there is STILL a way to effectively repeal the ACA, aka: Obamacare.  It is called reconciliation, and it merely requires a majority vote in the Senate.

Dan Benishek – Put Up Or STFU.  I name you specifically, because you are my congress critter. You are also arguably the most ignorant in Michigan of the power that congress wields.  Get this message across to the senate Republicans or get lost.  If you leave office and have not even tried to own up to the multiple promises you have made with regard to appeal of the ACA, then you are as much of a worthless liar and cheat as the president.

Folks, this is where today there is a growing contingent who see the wisdom of not giving Snyder his “lame duck” term, in which his Progressive agenda will go completely unchecked by just enough legislative losers who run with Snyder’s big government agenda. Is Mark Schauer a loser? Only about a shade paler that of what one can see with a term limited Rick Snyder.

Bottom line. If Conservatives must bird dog our Republican legislators to vote consistent to Party platform and principle, then we can do that just the same with a confirmed Democrat governor as we do with this center-Left abomination named Snyder under the Republican banner, now. Frankly, our task as Conservatives will most likely become easier with removing the facade of “going against their own” without Snyder.
