The Disaster That is Proposal 1

Sales Tax Retention on Off-Road Fuel Will Trigger Pandemonium in Michigan's Fuel Distribution Network

Let’s walk through the numbers and consequences of the most disastrous aspect of Proposal 2015-01: the retention of the sales tax on fuels used almost everywhere but on the roads. Most disastrous because this will be enshrined in our Constitution if Proposal 2015-01 passes. No act of our Legislature or sleight of hand by our Governor can correct the Michigan Constitution if Proposal 2015-01 passes. They can only decide to impose astronomical costs on the petroleum distribution network, create a lot of new criminals, spawn a black market in fuels, forego sales tax revenues, or some combination thereof. The Michigan Constitution gets its first intractable dilemma.

HCJR UU contains the actual language amending the Michigan Constitution. Sales and use tax rates go from 6% to 7%, and the sales tax is no longer permitted on “gasoline or diesel fuel used to operate a motor vehicle on the public roads or highways of this state”. So the plain language of HCJR UU authorizes continued sales tax collection on all gasoline and diesel oil which is not used to operate a motor vehicle on the public roads or highways of this state, at the new 7% rate.

This 7% ‘ORV’ fuel sales tax will be over and above the motor vehicle fuel tax, which continues to be applied to recreational off-road vehicle and marine fuels as a ‘privilege tax’ under PA 451 of 1994. To make things even more confusing for fuel suppliers and consumers, there will be a third category of fuel subject to the sales tax, but not the motor vehicle or privilege tax: fuel used industrially, for construction, for farming, for lawn care, generators, and other miscellaneous purposes.

Less noticed, the 7% sales tax is also authorized on fuels other than gasoline and diesel oil used to operate vehicles on the public roads or highways of this state. This is quite a surprise since PA 468 of 2014, the motor vehicles fuels tax law of the road tax package, goes to great lengths to bring alternate transportation fuels such as liquid or compressed natural gas and lighter alternative petroleum products (LPG, propane, etc.) into the general road fuels tax regimen. This is significant; the U.S. Energy Information Agency estimates that these alternate transportation fuels currently account for about 6% of ground vehicle propulsion on the public roads in 2009 and their usage is increasing sharply. The sales tax liability on these ‘green fuels’ will put them at a serious economic disadvantage to gasoline and diesel fuel. But this did not deter the Sierra Club and their fellow environmental wackos from endorsing Proposal 2015-01. David Holtz and the Michigan Sierra Club board would appear to have a ‘Common Core’ reading comprehension level.

The contentious May issue is complicated, but understandable. It just takes time.

And the argument is fierce. On one side we have the shills for the road industry pimping the YES vote, and the other side we have families who don’t much feel like picking out the switch so ‘daddy’ government can beat them down with an additional $500 a year in taxes.

(n.) A scapegoat is an event person or object that is used to lay the blame on for all that goes wrong, regardless of the contributions of others. This will usually carry on until the scapegoat has gone, or has managed to successfully defend itself against the arguments presented to it.

In the MIGOP the scapegoating is a never ending process, done to protect and deflect criticism of the new Sacred Cow of continued government expansion under Governor Rick Snyder.

Linda Lee lost as an incumbent, partially due to her out of context ramblings prior to the election concerning RNC Committeeman Dave Agema. (Some claim her bloviating during the BS organized  “Listening (to Linda) Tour” also cost her votes, but the events were so poorly attended I doubt the veracity of that claim). She and others need to take their own advice, and stop the Divisiveness. Her double standards are glaringly obvious, as illustrated by screenshots of a series of Posts she herself has allowed to remain on her page for almost a month now.  If Linda were not black, the posts could easily be called racist,  apparently they are just bitter grapes, a failure to accept election results, Ironic for someone employed as Director of Community Affairs & Election Integrity Liaison, allowed by a sore Loser.

Michigan Political Math: $ 1.2 Billion = $ 1.08 Billion

Mass Transit Skims $ 120 Million from Proposal 2015-01 Road Work Funds

Train Wreck ImageEver hear of the Michigan Comprehensive Transportation Fund? Ten cents of every Michigan fuel tax dollar gets diverted to this mass transportation slush fund.  It is only just behind the sales tax as a diversion of your current fuel tax dollars from Michigan’s roads.

All motor vehicle fuel taxes collected in the State of Michigan are first deposited into the Michigan Transportation Fund. Then MCL 247.660 (1)(f) (Public Act 51 of 1951) dictates that 10% of the funds deposited in the Michigan Transportation Fund be immediately transferred to the Comprehensive Transportation Fund. The amended version of MCL 247.660 you are being offered in Proposal 2015-01 has the very same section (1)(f), making the same 10% immediate diversion.

So the $ 1.2 billion that Proposal 2015-01 supporters are promising you for road work is actually only $ 1.08 billion.  Kirk T. Steudle, P.E. gets a whole new stash to maintain and expand his stable of rotting train cars, $ 120 million that cannot be spent on the roads by law.  $ 120 million that gets skimmed from the $ 1.2 billion you are being promised for the roads.  And no, it is not skimmed from the $ 800 million that Proposal 2015-01 dedicates to the Democratic base.

Now you now know how Michigan political math works in the age of Common Core.  Pay $ 2 billion for roads, get $ 1 billion in road work.

Candidate Rick Snyder (2010) vs. Gov. Rick Snyder (2012) On Guns

According to OnTheIssues.org, in 2010 then gubernatorial candidate Rick Snyder’s campaign website contained the following in regards to whether or not he would support the 2nd Amendment and the rights of gun owners:

“In one word: absolutely. I actually own three guns myself. I have a 12 gauge shotgun and two .22 rifles that I use for target shooting. I believe the 2nd amendment also protects the right of citizens to have a gun in their home to protect their family and property. I also support the rights of gun owners to responsibly carry their gun, as long as they have attained the legal permit. While I’m not an avid hunter, I support the industry and believe it plays an important role in our economy and quality of life. It also can have a valuable environmental conservation impact and I would work to streamline the processes so that hunters get better customer service from the state and local governments. We have a long tradition in our state of supporting gun rights and the hunting industry in Michigan and I would continue to support that tradition as Governor.”

Now there are two big problems with the highlighted portion. The first problem is that rights and permits are mutually exclusive. A right, by definition, is something that belongs fundamentally to everyone, as opposed to a permit which gives you the ability to do something you could otherwise do. The second problem is that when Gov. Snyder was given the opportunity to backup his words he folded.

Michigan Open Carry to initiate lawsuit against K-12 school district

Michigan Open Carry is going on the offense!

In a closed session, the Board of Directors for Michigan Open Carry has voted to partner with a plaintiff who was threatened with trespass for open carry of a holstered pistol at a public school. Details are going to be sparse for now given that the suit will be filed in two months (a strategic decision by the BoD).

HB 5108 Fights Crony Capitalism, Protects Personal Property Rights

You bought it...you own it!

It doesn’t matter the industry impacted or how long a law has been on the books. Any law that restricts our personal property rights in favor of crony capitalism should be abolished. That’s why lawmakers need to take action on House Bill 5108.

Right now, if you try to re-sell your sports or entertainment ticket above face value, you are a criminal under Michigan law. It doesn’t matter whether you are trying to unload a couple of tickets from your season ticket package or whether you can no longer go to that concert and only want to sell your tickets for face value plus “convenience fees.”

That is, unless you use a specially-designated “vendor” given a monopoly by the team or venue over all ticket resales. Companies like StubHub and Ticketmaster are milking honest fans by tacking on additional fees just for the “right” to resell a ticket that you already own and are turning around and paying a kickback to the venue for their state-protected monopoly.

House Bill 5108 will end this ridiculous law and open the secondary ticket market up to be more fair and free – everybody will have the same rights and nobody is forced to break the law or pay additional fees just to resell their own property.

The House passed the bill in the spring. And given the Republican supermajority in the Senate you would think this bill would be a slam dunk, right? Apparently not because the bill has been stuck in committee for months.

THIRD Party Rumblings (2nd Party, really…) and the REAL SOLUTION.

The Republican Party Needs an Enema! (barring that, some competition)

As individual operatives, patriots, and the “simply ticked-off” Americans engage in the political process once more in the intra-party politics of conventions, let us remember, this is not the only avenue. As you see the corruption and tactics of evil men in the party (holding onto their power at all costs) unfold, remember and that every road has its own pitfalls, opportunities and rules. Remember also, competition is a healthy consequence and a rich conservative tradition that Republicans have apparently forgotten when it applies to them or within their ranks. Consider the following…

With the primaries behind us for this election year, the disappointment and anger felt over those who lived sacrificially for the cause of liberty over the past 6-months-to-a-year is apparent and understandable, adding to the apathy of the spectators (who, if they’d actually gotten involved would have made a difference, but instead sought to confirm their apathetic notions with self-fulfilling prophecy after complaining). So now, I see people saying they’re thinking third party as recourse to the electorially ab[w]horrent behavior of the evil men and women in power in the Republican Party.

I’ve written about this before, and it always happens when people actually get involved in the electoral process, who naysay’d early warners beforehand about what kind of corruption and illegal activity is going on to keep the “right” people in power, from the highest offices in each district to the lowest. (Interestingly, the lower office you seek, the harder it is to find out how, which in itself is a means to keep power. Nice, huh?)

However, before anyone who reads this gets wound up with emotion about the issue, pro or con, consider the following with your higher intellect first, please. (For those who like conclusion first papers, skip to FACT 9, and then come back and read the rest. All others who prefer a logical progression to revelation, continue…)

1. Benishek wins 70-30.  Alan Arcand needs to fire his pollster.
3. Amash wins 57-43.  Probably not enough to scare away future primary challengers.
4. Moolenaar wins 52-36-11.  Never underestimate the Midland establishment.  I rated this a tossup when Mitchell led by 23.
6. Bussler gets 29% against Upton, confirming my suspicion that about 30% is the anti-Upton baseline in the GOP primary.
8. Bishop wins 60-40. No shock.  Schertzing survives a scare 43-38 in the dem primary.
