The left wing meme on the Flint Water fiasco is that Governor Snyder seized absolute control of Flint and installed doctrinaire Republican viceroys who ruthlessly slashed Flint’s payroll and expenditures without any regard for the residents.

Emergency managers are not viceroys with absolute powers. The evolution of emergency management in Michigan was frustrated by public union opposition. Five successive laws, one repealed by referendum. The law in force during the critical Flint water fiasco decisions is PA 436 of 2012. The powers it confers upon emergency managers are:

MCL 141.1549, Section 9

(2) Upon appointment, an emergency manager shall act for and in the place and stead of the governing body and the office of chief administrative officer of the local government. The emergency manager shall have broad powers in receivership to rectify the financial emergency and to assure the fiscal accountability of the local government and the local government’s capacity to provide or cause to be provided necessary governmental services essential to the public health, safety, and welfare. Following appointment of an emergency manager and during the pendency of receivership, the governing body and the chief administrative officer of the local government shall not exercise any of the powers of those offices except as may be specifically authorized in writing by the emergency manager or as otherwise provided by this act and are subject to any conditions required by the emergency manager.

The emergency managers replace the mayors, council, and chief administrative officers of the municipal governments. While this does indeed give them extraordinary powers of control, their control is anything but absolute. The municipal charter continues in effect and continues to protect the prerogatives of lesser bureaucrats. The vague statutory powers of emergency managers beyond replacing the mayor, council, and chief administrative officer poses unremitting legal jeopardy to emergency managers. Encourages timidity and bureaucratic subterfuge. Not absolute control.

Though yesterday’s ‘raid’ became less than eventful, it reminds us that the jackboot bureaucracy is always waiting for the slightest screw up by those whom it deems its ‘enemy.’ Mark is appreciative of those who on a moment’s notice showed up to witness.

Does EMU Have a Guilty Conscience?

Ivory Tower Finances in Michigan: No Pocket Left Unpicked, Other People's Crumbs for the Students!

In June, the EMU Board of Regents unanimously voted a 7.8% increase in tuition for students. Their new tuition rate for Michigan residents is $ 10,417.00 per year. This $ 754.00 annual increase – about four times the rate of inflation – was justified on the grounds that EMU’s tuition was thirteenth among Michigan’s major public universities. Its not like EMU’s past tuition increases had been held below the rate of inflation, its just that they had been more circumspect about raping forcing their students into perpetual debt slavery.

EMU specializes in disciplines which don’t command especially high wages, but they do generally qualify for our fearless leader’s Income Driven Repayment (IDR) debt forgiveness plans. So the EMU President and Regents probably figure that it is long past time time to tap the federal taxpayers for their grand delusions ambitions through their victims students. Who would notice a few millions more in delinquencies in a program which already has $ 187 billion in delinquencies?

Re-Writing Welfare In Michigan

blight-eliminationDon’t get me wrong.  I personally like some of the players in the bureaucratic mess we know as state government.

Elsenheimer in this story for example, is a relatively right of center guy.  Yet he has to feed the family, and the overly high taxes on his estate in GT County have to be paid. It would be an extraordinary act of courage to sit as executive director of a redistribution agency and wind it out of existence.  Even declining such an appointment might actually lead to worse people occupying the position and if market forces work, perhaps even be paid more.

How we can eliminate this type of government interference and theft, and return the high wage lackeys of ‘social justice’ back to honest wealth creation is the hard part.  In the meanwhile, ‘givers’ gotta give, and making the inexcusable seem oh-so-reasonable is just part of the job.

As an example of how words matter, one might look only as far as the most recent press releases propaganda from MSHDA.
