Very Sad News

Associate U.S. Supreme Court Justice Antonin G. Scalia was found dead this morning at Cibolo Creek Ranch, during a quail hunt in the Big Bend region south of Marfa, Texas. Natural causes are presumed.

Justice Scalia was the author of District of Columbia v. Heller, 554 U.S. 570 (2008), the landmark decision which held that the Second Amendment to the United States Constitution applies to federal enclaves and protects an individual’s right to possess a firearm for traditionally lawful purposes.

Justice Scalia was the most prominent advocate of originalism, the principle of constitutional law interpretation which finds the Constitution’s meaning was fixed at the time of enactment.  This philosophy has challenged the ‘living document‘ fraud promoted by lefties determined to reshape America in their socialist vision.

Justice Scalia’s legal wisdom informed innumerable Michigan court decisions and guided a generation of liberty oriented lawmakers across our entire country as well.  Historians will rank him with Oliver Wendell Holmes as the greatest two intellects ever seated on the U.S. Supreme Court.

We extend our deepest sympathies to his wife, Maureen Scalia,  and his nine children.  A terrible loss.

His passing will create a a legal (and political) vacuum, but for now let us thank God for allowing us 79 years of this great legal mind and wish him God Speed.

    It is amazing to me that those at even the highest levels of intellectual discourse can somehow bring themselves to get along.

    Perhaps those of us who aspire to same can learn something from Anthony Scalia and the historic life that he lived defending both his and our right to disagree.

      In ideologically split, democratically-elected, republican governments you do not get everything you seek immediately. Progress is halting, with periodic reverses. Learn to relish half of a loaf, it is much better than no loaf at all. At each succeeding engagement you can get more of the remainder.

      Our lefty opponents learned this long ago. Why they have implemented so much of their agenda over the last 100 years. Why we lost so much ground over that 100 years.

      Justice Scalia, as a good Italian boy, knew this:

          While I share your frustration with adverse SCOTUS decisions, you could only make this case if the adverse decisions were 9 - 0. Critical SCOTUS decisions have all been 5 - 4, which suggests a lot of politicking going on behind the scenes.

          SCOTUS has morphed into a legislative body where victors push the scope of each decision as far as they can without losing the critical fifth vote. That fifth vote is usually Anthony Kennedy; never was Scalia. Kennedy was also appointed by Reagan, whose only great SCOTUS appointment was Scalia

          Kennedy will be buried face down when he dies, so he can see where he is going. Scalia, on the other hand, deserves our heartfelt gratitude.

                  So your strategic expertise suggests that at the first setback, Justice Scalia should have resigned and allowed Zero to appoint a good socialist as his replacement? Justices Alito and Thomas as well? I am certain that Zero cherishes your strategic vision.

                  How would you allow a conservative Justice to perform his/her duties? Videoconferencing? Remember that a no fraternization rule means no changing the minds of colleagues. Treating your colleagues like lepers is certain to win you goodwill and accommodation. Guarantees a loss in every close decision.

            I am one of those who believe that the SCOTUS decisions should be unanimous or not at all. It was that way once upon a time.

            The court ought to be comprised of ALL originalists without question. You are correct about what it has morphed into.

    CS you think the people having the right to elect our two Senators somehow changed the values of the Supreme Court? Your comments above are off topic and quite frankly, have no business in this discussion. Justice Scalia's untimely demise could throw this country into further disarray. As for my thoughts, Justice Scalia played by the rules. He recused himself from matters wherein a mere slight appearance of impropriety existed. But two Justices, especially on the marriage ruling, which, by the way SCOTUS had no business hearing in the first place, actually married same sex couples contrary to the laws then and there existing. They should have recused themselves--and shame on them for this dishonesty. As for me, an avid reader of SCOTUS opinions, will miss the legal genius of Justice Scalia's writings.
