The State of Emergency needs to end. We have a handle on theraputics, recovery, etc., And, then there's personal responsibility. Those who hold liquor licenses have been ordered to continue the mandates until 10/23/2020, the date the appeal process expires (21 days). This is like comical since the sale of alcohol has increased 10-fold during this "crisis".
When the Emergency ends, it cannot be brought back under the same issue. This was discussions had during oral arguments, In otherwords, if the emergency ends, a new one cannot be declared for the same issue. In a nutshell, the 1945 law did not include pandemics, but did include riots. The 1978 law requires legislative input after 28 days. BUT, there's a 1941 law, involving public health and this is the law involving "'alternative sources of authority". The health department can not only levy mandates, but hefty fines too. The legislature needs to protect us IMMEDIATELY from this rogue agency and repeal the 1941 law ASAP. You've been warned.
