Michiganians must call Whitmer’s bluff.

The 1945 PA 302 does not grant unilateral power grab authority.  PA 390 Provided a check on her (or any governor’s) ability to extend such authority and subordinates PA302 with the addition of extension rules.

No one should adhere to her tyrannical decrees beginning May 1, unless Michigan’s legislature makes the mistake of extending her Emergency Declaration. Be strong and hold the line Michigan.

    Question: from where did the legislature, in 1945, derive the power to override the tenets of either the Michigan State, or US Constitutions? Neither has provision to allow such action. The closest the US Constitution gets is:
    “The Privilege of the Writ of Habeas Corpus shall not be suspended, unless when in Cases of Rebellion or Invasion the public Safety may require it.”
    I see nothing in the state constitution either, allowing any branch of government the power to suspend or override the constitution or any of its tenets. To the contrary, all members of the three branches are sworn to uphold both constitutions. So, please explain to me from where the legislature derived the power to grant such authority to the governor. unless someone has a real good answer to that question I must contend that the Emergency Powers Act of 1945 is unconstitutional.

      Clearly she has no authority to abridge the constitution of the state OR the US.

      The powers granted to her are merely those powers that the legislature has conferred (THEIR POWERS) under certain circumstance.

      There is nothing the legislature can do to abridge the US constitution, thus nothing the conferred to her allows it. She has operated outside her authority, and the legislature needs to reel her in.

      As for her violations and violating her oath to defend the constitution, she can be removed though I do not believe there would be support in the legislature.

      From the Michigan Constitution:

      § 7 Impeachment of civil officers.Sec. 7. The house of representatives shall have the sole power of impeaching civil officers for corrupt conduct in office or for crimes or misdemeanors, but a majority of the members elected thereto and serving therein shall be necessary to direct an impeachment

        She can be recalled by the electorate. That action requires action by the people at the ballot box without legislative apptoval.

          As much as she trashed billionaires in this state, surely they could throw a few scraps at us proles that could get her fat beer-swilling, now from her latest broadcast, totally disheveled mess after getting caught against HIPPA no bid contracts?

    After Friday's S-Show in Lansing, my snitches are telling me that due to that tried-and-true, time-tested motivator of the weak...fear, the legislature will be extending the deadline later this week into May. The only thing that needs to be pinned down is the exact date.

    This way, they can claim that they acted again to promote the "safety" of Michiganians, while simultaneously claiming that they did something to put a "check" on this obvious power grab.

    Or to put it in another way...they (will) buckle.

    Unfortunately, the citizens will need to step up and do the job that the Republicans in the Michigan Legislature lack the intestinal fortitude to perform. As long as our house arrest is still in place, it will be impossible to collect the number of signatures required to recall Gov. Witless. Although a petition drive to repeal BOTH emergency laws should be feasible.

    One last item, if you do contact your elected officials to complain, THE excuse that members have been coached into answering regarding how Gov. Witless can nullify the US Constitution is an obscure court case known as JACOBSON v. MASSACHUSETTS. Ironically, even though it doesn't call it by name, one of the arguments against Pastor Jacobson was that is promoted herd immunity. Something that is hard to do right now when an entire state is under house arrest.

    I recommend reading up on it before you call so that you can make your elected official a little more squeamish when their boss call them.

      Jacobson LOST. The Court sided with the state. The issue is not the same. How would bringing this up restrain the governor?

          Absolutely! Did YOU? City of Cambridge , Mass ordered Smallpox vaccinations. Jacobson objected. He lost. Vaccination order upheld. Again, how does this help to restrain yhe governor.

      It might be a lack of visibility. I missed the gridlock because I didn't know about it. I've been searching for others that will stand up to tyrants and fight for our freedom, rights and frankly our Country. Step up visibility and it can happen. People will sign a petition before they will committ to protest etc...

    And one last thing: INSIST that they take a roll call vote this week.

    Tell them that we are watching and that this voice vote nonsense won't fly. Don't resort to parliamentary tricks on why it cannot be done.

    If they can call a meeting at the last minute (last Friday) which wasn't on the schedule, then they can also change the process in which votes in the respective chambers are counted.

    Tell them to do their job and do it so that we know exactly how they voted this week.
