I live in Tim Walberg’s district. In fact, his residence of record is about 10 miles from my house. Those of you that live in a Rural setting may appreciate that this is “right around the corner”. I’ve not been a huge fan of Tim Walberg because of his repeated support for the PATRIOT ACT. I once confronted him over his support for this act at a tea party meeting and he and I got into it a bit. Anyhow…I smiled this morning while doing some quick research for this piece to discover Walberg sponsored legislation (albeit in 2015) to reform Civil Asset Forfeiture. Good job, Tim!
I hope Tim continues his Civil Asset Forfeiture reform efforts in the new congressional session.
The new leader of the United States Government, on the other hand, disappoints on this front. Many of you may have seen this video, I made this post for the benefit of those who have not.
A Texas lawmaker has the audacity to introduce legislation that requires the State Government there convict a fellow of a crime before they gank his stuff! GASP! What’s Trump’s solution? Ruin the lawmaker’s career!
I think we need to call out bad actors on Civil Asset Forfeiture (and other violations of civil liberties and due process), whether they are Republicans, Democrats, or a beloved (by many, not I) newly elected President. I recognize he’s not the only bad guy in this regard. Civil Asset Forfeiture was popular during alcohol prohibition — the better part of 100 years ago. Let’s hope Mr. Trump sees the error of his ways in the future.
One thing is for sure: he must NOT be given a pass simply because he’s a Republican (at least he says he is now — he was a Democrat between 2001 and 2009).
And they are correct. Justice Roberts and the presumed swing vote Justice Kennedy are completely happy supporting their leftist counterparts in rewriting the law and acting in a defacto legislative manner. In the meantime our cowardly Republican congress plans its next budget including the money used to screw over the population in a direct violation to the constitution.
The biggest cowards of course being our own Tim Walberg, Dan Benishek, Candace Miller, Bill Huizinga, David Trott, Mike Bishop, John Moolenaar, and perpetual sandbagging liberal Fred Upton. Without their support for continuing funding of the Obama plans, all of this would be moot. Without their capitulation to the sell out speaker of the house Obamacare would have been repealed by the purse. Without their complete and total disrespect for the Constitution of the United States, Obama and the complete and total change of our Republic under his guidance would be but a memory.
As for the ‘Democrats?’ We have know for quite some time that the Marxist infiltration of THAT party is complete.
Three side with the rule of law. Eleven put a blue ribbon on his prize.
Well .. craps.
For those of you getting a little excited about being able to finally be proud of our Michigan delegation? It’ll have to wait another day, or week, or decade in all likelihood. The vote? Three Michigan Republicans voted to enforce the rule of law through the ONE tool that congress has.
H R 240 YEA-AND-NAY 3-Mar-2015 3:14 PM QUESTION: On Motion to Recede and Concur in the Senate Amendment BILL TITLE: Making appropriations for the Department of Homeland Security for the fiscal year ending September 30, 2015, and for other purposes
Civil Asset Forfeiture Reform designed to restore 5th amendment protections.
The constitution laid out the responsibilities and roles of the different parts of the federal government.
However to clarify its scope and the limits, it was necessary to enact the bill of rights. And over the years, as different administrations championed their own versions of judicial conduct, even THAT became corrupted in application. Business owners and citizens have had to fight the leviathan of big government simply to retrieve confiscated property that was either improperly taken, or destroyed by overly zealous authority, even without criminal charges being filed.
Rep. Tim Walberg (R-MI), Sen. Rand Paul (R-KY), Reps Tony Cardenas (D-CA), Keith Ellison (D-MN), and Scott Garrett (R-NJ) are hoping to correct this, and once again clarify the meaning of due process, and restore the value of the 5th amendment. The Fifth Amendment Integrity Restoration Act is apparently designed to do that.

Not surprisingly, certain lawmakers scored higher than their supposedly ideological brothers. We have seen the squishy unprincipled selling out of the USA for far too long to not expect it to be revealed in this type of scoring.
