AFP: Michigan Should Join States Refusing Compliance with EPA’s Power Grab

Lansing, Mich. – Michigan can and should join other states that are refusing compliance with the Environmental Protection Agency’s power grab. That was the message from the grassroots free-market group Americans for Prosperity-Michigan in response to an announcement from the Michigan Agency for Energy that the state would develop a blueprint for reaching “targets” imposed by the Obama Administration under the so-called Clean Power Plan.

“Michigan shouldn’t put up with the Obama Administration’s regulatory bullying tactics at the expense of energy consumers,” said Pete Lund, state director of Americans for Prosperity-Michigan. “It is just ridiculous to believe Michigan can maintain control of our energy future if we cave to the EPA’s demands. Any regulatory road we choose to include in our state blueprint leads to the same federally defined destination—one that even President Obama acknowledges will result in higher prices for consumers.”

Lund noted that the EPA’s Clean Power Plan regulations still have to survive a gauntlet of court challenges. And, Michigan shouldn’t do the EPA’s dirty work by leveraging the assistance of state regulators in complying with mandates from the Obama Administration. Governor Snyder can and should join states like Indiana in simply refusing to submit a plan.

“In the end, it’s Michigan families and businesses who will shoulder the cost of this harmful rule,” said Lund. “Our state leaders should stand up for energy affordability and reliability in Michigan by rejecting efforts to implement them. Unfortunately Governor Snyder is doing the opposite.”

The EPA Clean Power Plan calls for Michigan to reduce emissions by 39.4 percent. Non-partisan research found that the “clean power” regulation would result in massive electricity rate hikes on Michigan families. By 2020 Michigan families will see their household electricity and gas bills increase by more than $950, a 47 percent increase. The total annual cost of power and gas will increase by over $10 billion.

“There is no reason to believe that submitting an implementation plan at this juncture will allow Michigan any leeway if the EPA’s power to implement these targets is upheld by the courts,” said Lund. “All we’d really be doing is crafting an energy plan that achieves federal objectives by selecting from a menu of tactics the Obama Administration has decided are allowed.”

    SCOTUS in Michigan v EPA, issued in July 2015 Held "The Environmental Protection Agency interpreted 42 U.S.C. §7412(n)(1)(A) of the Clean Air Act, which requires the agency to regulate power plants when “appropriate and necessary,” unreasonably when it refused to consider cost when making that decision. This is an important decision, but by the time it came down, all these FOR PROFIT corporations had already taken lots of federal grants to comply, with the costs trickling down to the consumer in the form of higher gas bills. This opinion means that EPA regulations cannot even be considered unless and until costs are considered. And, to make matters worse, the EPA is regulating (giving federal grants) FOR PROFIT corporations, giving these corporations lots of our tax monies for things like Smart Meters. What's in it for Michigan?????? Not a damn thing--I'm sick of all this!!!!!!!!

    In case you're not aware--federal grants is YOUR tax money, repackaged, with lots of strings attached and gifted back to anyone but "We the People". Honestly, we need a constitutional amendment which states--no public or private agency within this state shall accept federal grants, PERIOD!!!!!! Then we'll keep our federal taxes here at home and we'll decide how to spend them.
