Justice Maura Corrigan's possible departure from the Supreme Court is an uncomfortable one at best. As a federalist, she represents a more conservative tone on the state's highest court that is more in line with those folks who have an interest in the integrity of constitutional law, versus judging based on the most popular view of the day.
Its expected that she will be asked to serve as head of Michigan's Department of Human Services by Rick Snyder. It follows an apparent championing of family and health issues as she has earned the following awards (among others): Oakland County Champion of Children Award (2010); Michigan Children's Award (2008); U.S. Department of Health and Human Services for Innovative Partnerships (OCS) Award (2008); Michigan Family Support Council Judicial Award (2006); Vista Maria's Child Advocate of the Year Award (2005); the Congressional Coalition on Adoption "Angels in Adoption" Award (2005); the U.S. Department of Health and Human Services (OCS) Award for significant improvements to Michigan's Child Support Enforcement Program (2002) It follows that her passion for Michigan families and child welfare would lead her to accept such a position, even after serving in one of the highest offices in the state. I had mentioned before, the risk we have in losing any conservative on the court is great. In fact, given Snyder's seeming eagerness to be overtly NON-partisan gives rise to concerns he might pick someone 'suggested' by those who do not value such things as rule of law. I would stop short of considering our new governor as inept, but seriously consider the possibility that his previous absence in political experience might allow a lefty to slip through under the guise of a moderate.
It happened to Reagan and Bush nationally, and typical contenders for the Michigan Supreme court will not have the same notoriety. The Detroit news notes there are others who are aware of the possibilities: Mark Bendure, a Detroit appellate attorney who has represented plaintiffs in personal injury and civil rights cases, said: "The replacement of Maura Corrigan would be the swing vote." Bendure, as noted, is a plaintiff /civil rights attorney. Its likely the turned-out-in-November lefties are seeing this as an opportunity to flex their 'importance' muscles. Hence, my concern. Hopefully, the men surrounding Snyder who might offer advice on this issue make the appropriate suggestion of a Maura Corrigan clone.
