I am in the 1st district where I am taxed without representation.  Stupak is my Congressional Representative.

I found this podcast of the Frank Beckmann show, which is only accessible in these parts by computer streaming.

I am a huge fan of Frank Beckmann, even though I don't get to listen to him very often.

    The podcast runs 17 minutes, you should listen to it, but here is my take of what was said;

    On the Constitution

Things get a little contentious here, and this is why I like to listen to Beckmann.  He rightly points out that no where in the Constitution does it allow for the government to take over the health care industry.  Bart insists it does say so in Article I, Section 8 with the words the left have been using to bring the country to point it is today with rampant socialism and welfare programs that have done nothing but create a dependent society-"The Congress shall have power to lay and collect taxes, duties, imposts and excises, to...provide for.....general welfare...."

When Frank tells Stupak that we must look for the intent of the signers like Madison to understand the article, Bart says, "not everyone agreed with Maderson and Jefferson," and that if the government agrees that it is in the best interest of the nation, it is constitutional.  Frank replies:

The people who support the takeover of the Healthcare System here in America, like to cite that (Art 1, Sec 8) as broadly as possible.

The ones with a little more education will also bring up McCulloch v. Maryland for good measure.

    Two problems with those analogies:

First, if the Framers truly intended that to be the case, then why did they specifically enumerate 17 powers right beneath it?

"The Federal Government can do anything it wants...but we're gonna spell it out specifically below." Does that make any sense to anyone?

Second, they love to bring up the Supremes and McCulloch v. Maryland to support their arguments.

Well, the Supremes also came out with well-thought out decisions like Dred Scott v. Sandford and Plessy v. Ferguson.

Much like how Heller turned the tide on the attack on our Second Amendment Rights (which hopefully, McDonald will put to bed, toot sweet), we need to have them revisit this issue once and for all.

Dred Scott gave way to Plessy, which gave way to Brown.

I see no reason why we can't get this problem fixed in far less time, given the current makeup of the Court.

Awesome article and great comments. (none / 0) (#7)

Still, I just made a snap decision (Hey! Wouldn't it be grreat if I was an Obama adviser?) to call a spade a spade: Stupak is a liar.

that he doesn't agree with the framers of the Constitution.  So, any argument that what he is doing is against the Constitution is null and void because he doesn't agree with it.  He believes the Supreme Court is the Supreme "rule of law" of the land, and is willing to bet the Supreme court will find on his side.

The entire nation is run by lawyers.

    God help us all.
