The people who support the takeover of the Healthcare System here in America, like to cite that (Art 1, Sec 8) as broadly as possible.
The ones with a little more education will also bring up McCulloch v. Maryland for good measure.
Two problems with those analogies:
First, if the Framers truly intended that to be the case, then why did they specifically enumerate 17 powers right beneath it?
"The Federal Government can do anything it wants...but we're gonna spell it out specifically below." Does that make any sense to anyone?
Second, they love to bring up the Supremes and McCulloch v. Maryland to support their arguments.
Well, the Supremes also came out with well-thought out decisions like Dred Scott v. Sandford and Plessy v. Ferguson.
Much like how Heller turned the tide on the attack on our Second Amendment Rights (which hopefully, McDonald will put to bed, toot sweet), we need to have them revisit this issue once and for all.
Dred Scott gave way to Plessy, which gave way to Brown.
I see no reason why we can't get this problem fixed in far less time, given the current makeup of the Court.
