    Michigan: The Most Pro-Life State in the Union!

    After reflecting upon last week's column concerning the 35th anniversary of the U.S. Supreme Court's legalization of nation-wide abortion on demand, I have come to the conclusion that perhaps I came across as a little too gloomy.  

    While the pro-life movement has not yet achieved its pivotal goal of overturning Roe v. Wade, we are perhaps the closest to doing so since 1992, when the Supreme Court narrowly upheld the constitutional "right" to abortion in its decision in Planned Parenthood v. Casey.

    But more importantly, many states, and especially Michigan, are well-positioned to protect the lives of unborn children after the eventual fall of Roe.  

    Indeed, a renowned pro-life public interest firm, Americans United for Life, has - for the third time in its fifth annual survey - chosen Michigan as the most pro-life state in the entire Union!:

    "Michigan clearly understands the importance of life-affirming laws and the urgent need to legislate to prevent abuses of biotechnology. Building upon its enviable success in protecting women and the unborn from the negative consequences of abortion and criminal violence, Michigan bans both cloning-to-produce-children and cloning-for-biomedical-research. Michigan also prohibits destructive embryo research." See: http://www.aul.org/Your_State?p=72  

    For us pro-life Michiganders, this is something to be extremely proud of!  A lot of the credit for this "enviable success" is in no small part due to the outstanding work of Right to Life of Michigan - the National Right to Life Committee's largest and most successful state affiliate.  

    Long-time Right to Life of Michigan President Barbara Listing and the organization's dynamic legislative liaison, Ed Rivet, as well as so many others, have led this grassroots organization and have made real in-roads in the fight against abortion.  The fact that the state's abortion rate has decreased by nearly 50% over the last twenty years says it all.  

    Assuming that the fall of Roe is sooner, rather than later, Michigan is, indeed, currently well-positioned to eliminate its abortion rate altogether.

    Americans United for Life (AUL) recently conducted a "State Supreme Court Project, an in-depth look at state supreme courts' treatment of life issues and an examination of judicial restraint and/or activism at the state level.  [AUL] commissioned 50 white papers, covering the status of each state's supreme court, and examining judicial restraint and/or activism within that state."  See: http://www.aul.org/?p=130

    Entitled, "Michigan Law and the Scales of Justice, Life in the Balance," we found that our "[a]nalysis of the Michigan Supreme Court presents a strong statutory scheme protecting life and a court majority committed to principles of judicial restraint.  This jurisprudential commitment of the current Court to defer to legislative enactments, combined with Michigan's existing statutory scheme protecting life, presently provides an excellent platform for defending life, particularly with a vision toward the era after Roe v. Wade's reversal."

    In the first half of the white paper, we examine the state of Michigan's laws in the following areas: abortion, protection of the unborn from criminal violence, assisted suicide, healthcare rights of conscience, and human cloning and embryos.  In the second half, we characterize the judicial philosophy of the current conservative Michigan Supreme Court majority and provide information specific to the individual justices.  

    I encourage you all to check out our white paper.  When Roe falls, the legal battle over abortion in Michigan will move from the U.S. Supreme Court in Washington, D.C., to the Michigan Supreme Court in Lansing.
