    BREAKING! Radical Change to SB731!

    There is not question that one of the most controversial Michigan Senate bills proposed in recent memory was SB731.   731, the "Michigan quality community care council act" was rightly met by intense criticism by conservatives for what appeared to be "cover" for stealth unionization of home health care workers.  

    State Senator Jason Allen R-37th, the bill's primary sponsor has taken the bulk of the criticisms, with those critics citing the union friendly nature of the bill, and the seeming support for forced unionization for the independent health care providers affected.

    Allen has consistently denied those claims, stating his intent was merely to provide a mechanism which provided for the safety of the individuals receiving care that is paid for with state monies.  The writing of the original bill unfortunately had input from those with union interests at heart, and that input was incorporated originally, and ultimately inspired the backlash.

    The back lash was felt.  The people were heard.  And whether you call it a Mea Culpa, or simply righting a wrong, there is now a fix.

    Today Senator Allen presented, and has had a substitute voted out of the Senior Citizens & Veterans Affairs Committee this morning.

    SB731 has a new look.  (I will post the complete version soon)

    It says:

    "It is the intent of the legislature that this public act establish and ensure integrity within the home help program.  No part of this act shall be interpreted to allow for the unionization of home help workers.  Home help workers are not state employees and are exclusively employed by the home help consumer.  All employment decisions regarding a home help worker are to be made only by the home help consumer."

    It cannot be any more clearly stated.

    Further, with the language included in the senate budget, union dues are noncollectable by the state, and the home care workers are unionized only if they want to be for some reason.  They have NO obligation to the unions whatsoever.

    I must give credit to Allen for listening to the voters, and critics, and finding a way to correct what surely would have been a misuse of public trust.
