Prop 2 Dangerous For KidsBy JGillman, Section News
Its not just a radio or TV tactic.
There are real consequences that can happen as a result of this misguided Union takeover venture (PROP 2) of our constitution. Attorney General Bill Schuette on Thursday raised concerns about the devastating impact Proposal 2 would have on the safety of children in Michigan's public schools. His remarks come on the heels of new and misleading ads falsely claiming that Proposal 2 would not impact the safety of Michigan's schools and classrooms. Schuette was joined by Midland County Sheriff Jerry Nielsen and Eaton County Sheriff Mike Raines. Schuette said: "The fact is and the truth is, Proposal 2 will undermine 170 laws, including critical measures intended to keep children safe in our schools. A huge concern for parents is preserving the safety of their children both to and from school, and in the classroom. The legislature passed laws which provide safety tools like background checks to detect criminal records and drug or alcohol abuse before prospective employees set foot inside a school. According to Proposal 2's own language, Michigan parents, voters and lawmakers would be permanently prohibited from "limit(ing) the right to collectively bargain for wages, hours and other terms and conditions of employment." Schuette noted the broad language of the proposal would allow collective bargaining agreements to override laws like Public Act 103 of 2011, which prohibits collective bargaining over teacher discipline policies to keep kids safe from teachers who abuse drugs and alcohol, and Public 187 of 1990, which establishes minimum training and continuing education requirements for people operating school buses.
More below the fold.
It mixes up the entire state.
The end result would be a patchwork of different standards in different communities, because the so-called "right to bargain" enshrined in the State Constitution would supersede statewide standards that fall under the broad "terms and conditions of employment" label. Shuette says: "Proposal 2 would create islands of non-enforcement where commonsense public safety standards could be ignored."Equal treatment under the law anyone? Media outlets across the state have reported on a provision found in the contract collectively bargained by the teachers union in Bay City that would, prohibit the school district from terminating a teacher caught selling drugs on school property unless it happens twice. The same contract required a teacher be caught on school property under the influence of drugs three times and under the influence of alcohol at school at least five times before being removed from the classroom (Agreement between Bay City Public Schools and Bay City Education Association, pp. 92-93). Lawmakers in 2011, enacted Public Act 103, which legally prohibits such future agreements. If adopted, Proposal 2 would overthrow the protection afforded by Public Act 103. In fact, the same conclusion has been reached by the the Michigan Education Association's (MEA) Legal Department. According to a leaked internal memo (see attachment), passage of Proposal 2 would "immediately" overturn this protection and others intended to keep kids safe in schools. The MEA is one of Proposal 2's most prominent backers. The MEA's leaked memo states in part: "The new prohibited bargaining topics created by 2011 PA 103 and included in Section 15(3) of PERA would NO LONGER exist. This law currently prohibits bargaining over...Teacher discipline policies..." Nice. Keep an eye out at http://handsoffourconstitution.com/ for breaking news as well as here.
