Michigan Democrat Senator Bill Thomas of Detroit is on a crusade to stop people from texting while driving. In an interview Wednesday on WDET's "Detroit Today" program, Thomas described his bill to prohibit texting while driving as an important safety measure. As a secondary offense police couldn't pull someone over for the violation but could add a "texting" citation to another offense when appropriate. "There is some gray area," commented Thomas, when asked how the law would be enforced. According to Thomas, "No one would argue that a distracted driver is a dangerous driver, and no one would argue that there is no need to text or play games while driving." Ironically though, Senator Thomas didn't discuss the constitutionality of the proposed law. He did breeze over the fact that his Texting citation is a misdemeanor with a $100 fine. I could probably stomach a civil infraction and the fine. But seriously, a misdemeanor traffic offense for texting while driving is ridiculous. Not to mention the costs it will create in our courts as drivers everywhere lawyer-up to defend their clients against this unconstitutional and unenforceable law. Character crusader Sentator Bill Thomas is eager to focus on this bill even though Michigan's leadership is busy trying to avoid a government shutdown. The bill is currently before the energy and technology committee.
