Dillon pushing trial lawyer enhancement bills ASAP, GOP to counter with consumer protectionsBy Nick, Section News
Last week Right Michigan told you about the House Dems efforts to repeal Michigan's FDA defense laws. They'd approved, in committee, bills to permit trial lawyers to sue pharmaceutical companies and researchers, bilking billions out of Michigan's life-sciences industry. This week they're looking to take the next step, passing the legislation in the House, siding, on record, with the trial lawyers over Michigan job providers. At the same time, they'll have to vote on a handful of GOP sponsored consumer protection amendments.
By way of reminder, the FDA tests drugs. They make sure they do what the drug companies say they do. They make sure they're safe for use under a doctor's supervision and that all of the correct interaction and warning labels are properly applied and ready for marketing.
Once the FDA approves a drug, its back on the drug companies to sell them and to comply with the standards the FDA has set for the sale and marketing. If you believe the warning labels misrepresented the risk, or you think the drug company foisted something on you fraudulently you go to the FDA, you tell them what happened (they take these sorts of things seriously) and if the FDA figures out the company really did misrepresent their drugs or didn't tell the whole story about them then you get to sue! The fact that Andy Dillon's majority is supporting their special interest buddies isn't a surprise. What is surprising is the cold response given thus far to consumer protection amendments offered by members of the republican minority. After all, all of the rhetoric leading up to this vote has been about how important it is to give Michigan residents the ability to collect damages. To make residents whole again. Dillon and his friends on the House floor never came out and said anything about helping personal injury lawyers make an extra million or two. Not with cameras and microphones around anyways.
State Reps. Tonya Schuitmaker, Tom Casperson and Bruce Caswell will introduce and push to add amendments allowing victims to receive more of any settlement money they might win in court, create a victims' fund from attorney fees and allow courts to impose sanctions on trial lawyers and law firms caught ambulance chasing and initiating frivolous lawsuits among others. "For years now, personal injury lawyers like Sam Bernstein and Geoffrey Fieger have lined the pockets of the Democratic Party. Now, Democrats in the House are trying to return the favor because these attorneys, and others like them, stand to make millions," said Casperson, R-Escanaba, in a prepared statement. "If the FDA defense is repealed in Michigan, Republicans in the House believe that patients, not profiteering lawyers, should benefit." Well, the legislation is likely on its way soon to the Senate. And likely minus consumer protections. Nice work by the GOP minority in working to get the Dems on record opposing families and job providers in favor of ambulance chasers, if nothing else.
