      Just because Congress doesn't say it's a tax doesn't mean it's not a tax.

      If it looks like a duck, swims like a duck, and quacks like a duck, then it probably is a duck.

      If they started calling it an "income penalty" and had that collected by the IRS, that wouldn't change the fact that it's still an income tax.

      I have read the Constitution (many times), and did quite well in Constitutional Law, and government in high school. ;)

      There is no violation of the Tenth Amendment here, because the power to tax was delegated to the United States.
