      To give the selection the veneer of impartiality, in most places that have "merit selection" it is usually a committee appointed by the state bar association that chooses the judicial candidates. The state bar associations are overwhelmingly run by plaintiff trial lawyers, so they will pick like-minded candidates. In Arizona they run a variation where the panel sends up a slate of candidates for the Governor to pick from; but if you send up a slate that consists of Goodwin Liu, Sonia Sotomayor, Randall Robinson, and Henry Louis Gates, it seems rather likely that a liberal judge will end up being selected on "merit".
