      Forming a political party... (none / 0) (#15)
by Seth9 on Fri Sep 03, 2010 at 06:25:45 PM EST
Forming a political party is a method of exercising your First Amendment right to free speech. Making it difficult to exercise this right via excessive, complicated regulations is a method that the state can use to effectively restrict this right, thus undermining the Constitution. This argument does not translate to the tax code because it does not involve a constitutionally-protected right. It does, however, translate to things like gun-ownership laws.

I am once again going to reiterate that I do not approve of the actions taken by the FTP. That said, if the SOS denied an applications by real Tea Party activists to form a third party on the grounds that they used the wrong type of font at one point on their application, then I doubt that anyone here would be claiming that such a ruling was necessary to enforce the rule of law.
