Jason, Libertarians would not back the execution of unarmed civilians by military forces that you are endorsing here. I can only believe that you are being facetious, as reasonable men would never endorse a policy of the mass murder of unarmed people, whether they are criminals or not.
The military's only function should be to protect against invading ARMIES, not impoverished people coming to work in another country, even illegally. If we can not at least agree on something as fundamental as that, then surely you will never convince me to return to conservatism.
Ok, let's establish what we agree on.
From what I can tell, we agree that:
a) The requirements for entry should be reduced. Essentially make sure that they aren't working with some outfit that's planning on doing nasty shit.
b) As such, there should be a method for filtering the incoming population to support a).
We good on the above?
I'm not a policy wonk or a spook - I won't make recommendations how to most effectively and efficiently verify the incoming population is legit and won't be sucking off welfare (like it or not, that shit's gonna be around for a while unfortunately).
However, without having the ability to funnel everyone through some kind of ECP to get checked, you might as well just say it's a damn free for all.
Yes, a border jumper might be some dude trying to get in to do legit work, but it also might be some guy running bomb materials. I don't know that. You don't know that. All I know is I see a guy that just breached our border without being checked out. Assuming an effective/efficient method of checking an incoming population, there is absolutely no reason for him to be jumping a border unless he's got some nasty shit he's trying to get in.
Securing the border by force (which could include non-lethal methods as well, I'm just opining that lethal force should be authorized) would actually solidify civil rights inside the country as well.
Think of it kind of like a murder/attempted murder or home invasion situation. If you stop the guy in the act, you know you got the right guy. On the other hand, if someone is picked up after the fact, it's possible you might get the wrong guy.
If you make it so that there's an incentive to go through an ECP to get checked out on the way in, eliminating most border jumping, then there will be NO LEGITIMATE REASON that people could use to support "papers, please" policies.
