      I'm not sure I would agree with the idea that there are victimless crimes.  But I would agree that acts that are only malum prohibitum rather than malum in se could certainly qualify for some sort of alternative sentence.  I am not advocating for the decriminalization of these acts, but community service, fines, drug testing, and work release programs may be a more suitable form of punishment than prison for these specific offenders.
