      I think that Dowdy is a devastating case for Judge Markey.  Not only was her position unanimously overruled by the Rule of Law majority on the MSC (and in fact only advocated by the empathy-style Justices), but it is contrary to common sense: why on earth would the Legislature enact a law that requires all sex offenders to register except for those who are homeless?  I have read the Dowdy decision, and it is not like the concept of "domicile" is new in Michigan law.  Going back to the 19th century, the rule in Michigan (and nationally) has been that every person has a domicile; thus, when the Legislature requires sex offenders to register their residence or domicile, it is pretty obvious that the Legislature requires even people witout traditional homes to have to register for the protection of society.  

      In my estimation, Dowdy is perhaps a decision that could sink the Markey nomination.
