      . . . a 6th Circuit decision from 2002 (if my memory serves correctly) is the governing case here.

      As Kevin and I said, the precedent here is ACLU of Ohio v. Taft.  Although that precedent only applies to Tennessee, Kentucky, Ohio, and Michigan.  If it's ever taken to the SCOTUS, I'd like to see the decision overturned and expand the length of time where an appointee would be permissible instead of holding a special election.
