If they had only stuck to principles... (5.00 / 1) (#2)

      ...this would be a non-issue.

One of the arguments that we have against Obamacare is that the government had absolutely no Constitutional Authority whatsoever when they wrote it in the first place.

The same can be said for this bill.

Article I § 10 of the Michigan Constitution is explicitly clear.

"No bill of attainder, ex post facto law or law impairing the obligation of contract shall be enacted."

Rep. Hooker made a great point (Page 6)
on why Mr. Schostak is going to have a problem in the Michigan Supreme Court when they hear his appeal.

"I voted no because this has been and should be decided in the courts. The courts asked for clarification as to what Nonrecourse
meant. While I support the concept of clarification of nonrecourse, the bill contained a retroactive section which
goes back and could reverse decisions by the court. An amendment was offered to try to eliminate retroactivity but was
      gaveled down.
      Hence, my no vote."

Yes, they did get some democrats to sign off on this bill. However the republicans will still have an interesting time trying to explain away why this isn't, as you've described it, "pure payola".
