      Would not "Gives consent" be similar to a Preliminary Breath Test?  A roadside breath test can be, and should be in my opinion, refused albeit with penalty, even with "Implied consent" of license possession.  Submitting to a PBT is "Gives consent" for information gathering purpose for arrest.  Legally, a warrant must be obtained.
