As you say, there may be no legitimate defense for the law, but it is what it is and to think that the total percentage of smokers if allowed to smoke in businesses would turn the economy around is a very, very long stretch, highly improbable. As desperate as many state economies are, there are approximately 38 other states with similar law, trying to eke out every nickel and not one to my knowledge has reversed it, even for money.
