    Most of what the US government does today is unconstitutional, and that doesn't seem likely to change any time soon.  The Congressman's comments accept that as a given reality, and deal with the current issue.  

    I'm all for rolling things back to constitutional limits too.  It's just a very distant conservative dream at this point though.  It's an easy thing to add a government program.  Once people are depending on it though, it's a major ordeal (politically and logistically) to eliminate it.
