A vote of the people does not trump constitutional law or rights. This is what separates us from history. If people today need a reminder, they should read up on the REASONS for representation in govt. If memory serves, the short answer is because people can be whipped up emotionally and do some stupid things as a group; yet as thoughtful individuals, like wise men/women elected to office, issues can be debated fully and rationally. Sometimes, such representatives even need to come back and educate their constituents on an issue, but need to be on the side of the Law to do so properly; otherwise, they should listen to their constituents, unless it is a matter of conscience. It's really a fine line to walk, but one our current representatives are clearly out of line on.
