Someone might challenge the law in that it doesn't give the business the same equal access to engage First Amendment persuasion of workers.  This argument has been suggested on the front end - but it makes sense in the way you put it - the business (or non-union workers that are trying to organize other or no union) should have a back-end reversal right that is equal to the front-end right.
