Michigan Open Carry to initiate lawsuit against K-12 school district

Michigan Open Carry is going on the offense!

In a closed session, the Board of Directors for Michigan Open Carry has voted to partner with a plaintiff who was threatened with trespass for open carry of a holstered pistol at a public school. Details are going to be sparse for now given that the suit will be filed in two months (a strategic decision by the BoD).

While we believe that schools are preempted against having their own firearms regulations under Capital Area District Library v. Michigan Open Carry, there have been a few situations where schools have trespassed, or threatened trespass against individuals with their CPL who open carried on school property. We’re hoping for a published opinion in our favor at the Michigan Court of Appeals (which would make the issue binding across the state).

Dean Greenblatt, who represented MOC in the CADL case, will also be handling this case.

I would think that even if we win in circuit court and the school doesn’t appeal to the CoA, it will still chill other districts when it comes to threatening the citizenry who wish to open carry on school grounds.

Of course, I’ll be throwing out the obligatory “please donate“.

    The open carry of properly holstered handguns is legal in 45 states, if you include California, a rural only open carry state. 30 states allow open carry without a permit, including Michigan (though a concealed pistol license is required to open carry in certain locations such as K-12 schools, bars, banks, and hospitals).
